These terms govern your use of the Dive Deep Dating app, website, and related services (together, "the Service"). By using the Service, you agree to these terms. We've written them in plain language to make them easy to understand.

Dive Deep Dating is part of the Dive Deep Dialogues family of apps.

Who Can Use the Service

You must be 18 or over to use Dive Deep Dating.
We ask for your date of birth when you create an account, and keep only the fact that you are 18 or over.
Spicy Mode asks you to confirm you are 18 or over before it opens.

What the Service Provides

Dive Deep Dating offers:

Educational content and conversation tools: not professional advice
AI coaching (Sparky): an AI dating coach, not a person, and not a therapist or counsellor
Conversation facilitation: guided questions and games for dating conversations
Voice and video calling: calls between the two people in a session, without sharing phone numbers
Self-improvement resources: confidence building, a readiness self-check, and guides that name their sources

The Service is not: a dating or matching platform, a substitute for therapy or professional counselling, or a source of medical, legal, or financial advice. Always use your own judgement when making relationship decisions. If you are experiencing distress, please contact a qualified professional or your local crisis support service.

AI Coaching (Sparky)

Sparky is an AI-powered dating coach that provides personalised guidance based on your conversations. By using Sparky, you understand and agree that:

Sparky is not a therapist. Coaching conversations are educational and supportive, not clinical. If Sparky detects you may benefit from professional support, it will say so and suggest appropriate resources.
Sparky remembers your context. To provide personalised coaching, Sparky retains information you share (goals, situations, patterns) across sessions. This data is stored in Google Cloud (Firebase) in Sydney, Australia.
Your coaching conversations are never used to train AI models. Your conversations with Sparky are processed by our AI provider (Anthropic's Claude, through Anthropic's API) to generate responses, but are never used to train, fine-tune, or improve any AI model.
AI has limitations. Sparky's advice is generated by AI and may occasionally be inaccurate, incomplete, or unsuitable for your specific situation. You are responsible for your own decisions.
Sparky is shared across the Dive Deep Dialogues apps. The basics Sparky knows about you (your name, country and preferred coaching style) are kept in one profile that the coaches in our other apps also use. What you discuss in Dive Deep Dating is kept under this app.
Free and paid limits. Sparky is free for 5 messages a day. The coaching add-on raises that to 25 a day.
You can delete your coaching data. You may request deletion of your coaching conversation history at any time by contacting us or using the privacy controls within the app.

Session Mode (Couples and Multiplayer)

A session joins two people through a six-character code. What you put into a shared session is shared with the other person: the answers you type, the ratings you give in First Dates "Talk It Out", and chat messages. Notes you write for yourself are never shared. A session expires four hours after it starts.

When using session-based features, you agree to:

Ensure all participants consent to taking part
Obtain mutual agreement before sharing assessments or results with anyone outside the session
Keep session codes private and secure. Anyone with the code can join a session that is still waiting for its second person
Maintain respectful communication throughout
Respect that any participant can leave a session at any time

Voice and Video Calls

Dive Deep Dating offers voice calling (free) and video calling (paid add-on) to enable conversations without sharing personal contact details. By using these features:

Calls connect your two devices directly where the networks allow. Where they do not, the call passes through a relay run by Cloudflare. Either way the call is encrypted between the two devices. We do not record calls and cannot listen to them.
No phone numbers are exchanged. Connections are made via session codes only.
A call is still an internet connection. As with any internet call, each person's device can see the other's IP address, which can indicate a rough location.
Either party can disconnect at any time with one tap. There are no callbacks or follow-ups.
You must not use voice or video calls for any unlawful, threatening, harassing, or abusive purpose.

Paid Add-Ons and Subscriptions

Add-Ons

The following optional add-ons are available for purchase:

Video Calls: $7.99 AUD for 3 months
Dating Confidence Coaching (Sparky): $7.99 AUD for 3 months (upgrades from 5 to 25 messages per day)
Spicy Mode: $4.99 AUD for 3 months
Date Night Bundle (Video + Spicy): $9.99 AUD for 3 months
Dive Deep Dating Complete (Video + Coaching + Spicy): $13.99 AUD for 3 months

Add-ons grant access for a fixed 3-month period from the date of purchase. They do not auto-renew. When the period expires, you retain all free features, including 5 free coaching messages per day.

When you purchase an add-on, your partner or session guest inherits access to that add-on for the duration of any session you create.

Dive Deep Dialogues Subscriptions

A paid Dive Deep Dialogues subscription (DDD Plus, DDD Family or DDD Family+) is a monthly recurring subscription that includes all Dive Deep Dating add-ons. A free Dive Deep Dialogues account does not. Subscriptions are managed through your Dive Deep Dialogues account and can be cancelled at any time from your account settings. Cancellation takes effect at the end of the current billing period.

Payments

Payments on this website are processed securely by PayPal. We do not see or store your payment card details. Prices are in Australian dollars (AUD).

Refunds

If you are unsatisfied with a purchase, contact us within 14 days at contact us and we will assess your request under the consumer law that applies where you live (in Australia, the Australian Consumer Law). Digital products that have been substantially used may not be eligible for a full refund, but we will always try to find a fair resolution. Nothing here limits a refund the law gives you a right to.

Your Account

You can use much of the Service without an account. What you save then stays on your device.
You may sign in via the Dive Deep Dialogues Auth Hub using email, Google, or Apple sign-in.
You are responsible for keeping your account credentials secure.
One account per person. Accounts are not transferable.
We reserve the right to suspend or terminate accounts that violate these terms.

Privacy

Your privacy is important to us. Key points:

Data saved to your account is encrypted in transit and at rest by Google Cloud. What is kept in your browser is not encrypted
Calls are encrypted between the two devices. We do not record them and cannot listen to them
Coaching conversations are stored in Sydney, Australia, and are never used to train AI
You can export or delete your data at any time

Your Responsibilities

When using the Service, please:

Be honest and authentic in your responses
Treat other participants with respect during conversations
Keep session codes private
Use good judgement in all interactions
Not use the Service for any unlawful, harmful, or abusive purpose
Not attempt to extract, scrape, or reverse-engineer any part of the Service

Content and Copyright

You Can:

Use our content for your personal relationship growth
Save your responses and coaching conversations for personal use
Share your experience with others

You Cannot:

Copy or redistribute our questions, coaching prompts, or content
Use our content for commercial purposes
Reverse-engineer the app or its AI systems

Changes and Updates

We regularly update the Service with new content and features
These terms may be updated periodically
We will notify you of significant changes via the app or email
Continued use after changes constitutes acceptance of the updated terms

Limitation of Liability

The Service is provided "as is" without warranties of any kind
We cannot guarantee uninterrupted or error-free service
We are not liable for relationship outcomes or decisions made based on the Service
AI coaching responses may contain inaccuracies. You are responsible for evaluating advice
To the maximum extent permitted by law, our total liability is limited to the amount you have paid us in the 12 months preceding any claim
Nothing in these terms excludes or limits liability that cannot be excluded under the consumer law that applies to you, including the Australian Consumer Law

Legal Framework

These terms are governed by the laws of New South Wales, Australia
The courts of New South Wales have non-exclusive jurisdiction over any disputes
