Welcome to Dive Deep Dating

These terms govern your use of the Dive Deep Dating app, website, and related services (together, "the Service"). By using the Service, you agree to these terms. We've written them in plain language to make them easy to understand.

Dive Deep Dating is part of the Dive Deep Dialogues family of apps.

What the Service Provides

Dive Deep Dating offers:

• Educational content and conversation tools — not professional advice
• AI coaching (Sparky) — a personalised dating coach, not a therapist or counsellor
• Conversation facilitation — guided questions and games for dating conversations
• Voice and video calling — peer-to-peer connections without sharing phone numbers
• Self-improvement resources — confidence building, readiness assessments, and psychology-backed guides

The Service is not: a dating or matching platform, a substitute for therapy or professional counselling, or a source of medical, legal, or financial advice. Always use your own judgement when making relationship decisions. If you are experiencing distress, please contact a qualified professional or your local crisis support service.

AI Coaching (Sparky)

Sparky is an AI-powered dating coach that provides personalised guidance based on your conversations. By using Sparky, you understand and agree that:

• Sparky is not a therapist. Coaching conversations are educational and supportive, not clinical. If Sparky detects you may benefit from professional support, it will say so and suggest appropriate resources.
• Sparky remembers your context. To provide personalised coaching, Sparky retains information you share (goals, situations, patterns) across sessions. This data is stored securely with Australian data residency.
• Your coaching conversations are never used to train AI models. Your conversations with Sparky are processed by our AI provider (Anthropic Claude via Google Vertex AI) to generate responses, but are never used to train, fine-tune, or improve any AI model.
• AI has limitations. Sparky's advice is generated by AI and may occasionally be inaccurate, incomplete, or unsuitable for your specific situation. You are responsible for your own decisions.
• You can delete your coaching data. You may request deletion of your coaching conversation history at any time by contacting us or using the privacy controls within the app.

Session Mode (Couples and Multiplayer)

When using session-based features, you agree to:

• Ensure all participants consent to taking part
• Keep your answers private unless choosing to share
• Obtain mutual agreement before sharing assessments or results
• Keep session codes private and secure
• Maintain respectful communication throughout
• Respect that any participant can leave a session at any time

Voice and Video Calls

Dive Deep Dating offers voice calling (free) and video calling (paid add-on) to enable conversations without sharing personal contact details. By using these features:

• Calls are peer-to-peer. Audio and video data flows directly between participants. We do not record, store, or have access to the content of your calls.
• No phone numbers are exchanged. Connections are made via session codes only.
• Either party can disconnect at any time with one tap. There are no callbacks or follow-ups.
• You must not use voice or video calls for any unlawful, threatening, harassing, or abusive purpose.

Paid Add-Ons and Subscriptions

Add-Ons

The following optional add-ons are available for purchase:

• Video Calls — $7.99 AUD / 3 months
• Dating Confidence Coaching (Sparky) — $7.99 AUD / 3 months (upgrades from 5 to 25 messages per day)
• Spicy Mode — $4.99 AUD / 3 months
• Date Night Bundle (Video + Spicy) — $9.99 AUD / 3 months
• Dive Deep Dating Complete (Video + Coaching + Spicy) — $13.99 AUD / 3 months

Add-ons grant access for a fixed 3-month period from the date of purchase. They do not auto-renew. When the period expires, you retain all free features — including 5 free coaching messages per day.

When you purchase an add-on, your partner or session guest inherits access to that add-on for the duration of any session you create.

Dive Deep Dialogues Subscriptions

Ecosystem subscriptions (DDD Plus, DDD Family, DDD Family+) are monthly recurring subscriptions that unlock all add-ons across all Dive Deep Dialogues apps. Subscriptions are managed through your Dive Deep Dialogues account and can be cancelled at any time from your account settings. Cancellation takes effect at the end of the current billing period.

Payments

All payments are processed securely via PayPal. We do not store your payment card details. Prices are in Australian Dollars (AUD) and are the same on all platforms (web, iOS, Android).

Refunds

If you are unsatisfied with a purchase, contact us within 14 days at contact us and we will assess your request in accordance with Australian Consumer Law. Digital products that have been substantially used may not be eligible for a full refund, but we will always try to find a fair resolution.

Your Account

• You may sign in via the Dive Deep Dialogues Auth Hub using email, Google, or Apple sign-in.
• You are responsible for keeping your account credentials secure.
• One account per person. Accounts are not transferable.
• We reserve the right to suspend or terminate accounts that violate these terms.

Privacy

Your privacy is important to us. Key points:

• Your personal data is encrypted in transit and at rest
• Voice and video calls are peer-to-peer — we never access the content
• Coaching conversations are stored securely with Australian data residency and are never used to train AI
• You can export or delete your data at any time

Your Responsibilities

When using the Service, please:

• Be honest and authentic in your responses
• Treat other participants with respect during conversations
• Keep session codes private
• Use good judgement in all interactions
• Not use the Service for any unlawful, harmful, or abusive purpose
• Not attempt to extract, scrape, or reverse-engineer any part of the Service

Content and Copyright

You Can:

• Use our content for your personal relationship growth
• Save your responses and coaching conversations for personal use
• Share your experience with others

You Cannot:

• Copy or redistribute our questions, coaching prompts, or content
• Use our content for commercial purposes
• Reverse-engineer the app or its AI systems

Changes and Updates

• We regularly update the Service with new content and features
• These terms may be updated periodically
• We will notify you of significant changes via the app or email
• Continued use after changes constitutes acceptance of the updated terms

Limitation of Liability

• The Service is provided "as is" without warranties of any kind
• We cannot guarantee uninterrupted or error-free service
• We are not liable for relationship outcomes or decisions made based on the Service
• AI coaching responses may contain inaccuracies — you are responsible for evaluating advice
• To the maximum extent permitted by law, our total liability is limited to the amount you have paid us in the 12 months preceding any claim
• Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law

Legal Framework

• These terms are governed by the laws of New South Wales, Australia
• The courts of New South Wales have non-exclusive jurisdiction over any disputes
• Nothing in these terms excludes your statutory consumer rights under Australian Consumer Law
